The Holy Quran says in Chapter 16, Verse 90:
Indeed, Allah enjoins justice and benevolence (towards everyone)!
With great respect to your honor, I humbly submit that everyday my innocent brothers are being extra judicially murdered in Karachi, the Economic Hub of Pakistan. My lord, the pain and sufferings of the families of victims of such barbaric and inhuman behavior of our Law Enforcement Agencies is un-tolerable and no organ of the state (which is liable to provide the security of life and liberty to the citizens of Pakistan bestowed upon them under Article 9 of the Constitution of Islamic Republic of Pakistan), is doing efforts to save more innocent lives falling prey to the barbarism.
Your Honor, since the start of Karachi Operation, more than 45 citizens residing in Karachi are missing after they were held by Law Enforcement Agencies. The families of these missing persons are in terrible grief as the authorities are continuously denying the arrest, which was exercised in the presence of their families from their houses or work places where their colleagues are witness of their arrest.
Respectfully Sheweth, the Constitution of Islamic Republic of Pakistan empowers your lordship to invoke extra ordinary jurisdiction under Sub Article (3) of Article 184 where the matter pertains to public importance and that it relates to the enforcement of fundamental rights conferred by Part II, Chapter I of the Constitution and specially where the inalienable right of Life & Security of a person is being denied.
My Lord! With utmost respect it is submitted that under the Constitution of Islamic Republic of Pakistan, The Court is bound to discharge its duties and perform its functions honestly to the best of its ability and faithfully in accordance with the Constitution and the law of The Islamic Republic of Pakistan and do right to all manner of people, without fear or favor, affection or ill-will.
In Surah Al Israh (17), Verse 70. Almighty ALLAH says:
“And indeed We have honored the Children of Adam, and We have carried them on land and sea, and have provided them with At-Taiyibat (lawful good things), and have preferred them above many of those whom We have created with a marked preference.”
My Lord! Almighty ALLAH has created all humans equal and they must be treated with honor, respect and regard, without distinction of any kind, such as the color of their skin, their race, descent, social background, national origin, gender, age, language, religion, political or other affiliation, education, occupation, job, wealth, property or any other status. There is no aristocracy, religious elite, priesthood or any privileged class in Islam. And it is also the settled principle of Justice that no one shall be above the law.
Your Honor! Many petitions are still pending in the High Court of Sindh, regarding the recovery of missing persons picked up by Law Enforcement Agencies and are yet to be heard. The victim families are complaining that instead of day to day hearing, the Courts are adjourning their matters for long date which in return is more painful.
It is therefore, respectfully prayed that your Lordship may take Suo Moto notice of the violation of fundamental human rights carried out by the Law Enforcement Agencies in the name of Karachi Operation. Your Lordship may also issue directions to the Honorable High Court of Sindh to constitute a Special Bench for dealing cases of Extra Judicial Murders and of Missing persons on day to day basis for ensuring that the culprits involved in such barbaric acts may be dealt in accordance with the law and speedy justice is served.
My Lord! I am addressing to your Lordship with the faith that, being the custodian of the Constitution of The Islamic Republic of Pakistan, your Lordship will invoke extra ordinary Jurisdiction and provide speedy Justice to the families of missing persons and victims of Extra Judicial Murders.
